1. Introduction

Welcome to Cibru ("we," "our," or "us"). By accessing or using our gamified learning platform, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Eligibility & Age Requirement

You must be at least 13 years old to use this platform. By creating an account and using Cibru, you confirm that you meet this age requirement. If you are under 18, you should review these terms with a parent or guardian.

We do not knowingly collect personal information from children under 13. If we become aware of such data, we will take steps to delete it promptly.

3. User Accounts

To access certain features, you must create an account. You agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Privacy & Data Collection

Your privacy is important to us. Here's what you should know about how we handle your data:

• Data We Collect: Email address, display name, profile information, messages, test results, and usage data.
• How We Use Data: To provide and improve our services, personalize your experience, and communicate with you.
• Third-Party Services: We use Firebase (Google) for authentication, database, and storage services. Your data is subject to their privacy policies as well.
• Data Storage: Your data is stored securely on cloud servers. We implement industry-standard security measures to protect your information.
• Data Sharing: We do not sell your personal data to third parties. Data may be shared only as required by law or to protect our legal rights.

5. Gamified Features & Virtual Currency

• Diamonds: Our platform uses a virtual currency called "Diamonds" which can be purchased or earned. Diamonds have no real-world monetary value and cannot be exchanged for cash or transferred outside the platform.
• Purchases: You may purchase Diamond packs (e.g., 50 Diamonds for $0.79, 100 Diamonds for $1.49, 500 Diamonds for $4.99). All purchases are final and non-refundable unless required by law.
• Quests & Levels: We reserve the right to modify completion criteria for quests, adjust point values (XP), or reset levels in the event of system abuse or balancing updates.

6. Pro Membership

We offer a Pro Membership subscription that provides enhanced features, including ad-free experience, boosted rewards, monthly Diamond bonuses, and exclusive customization options.

• Billing: The subscription is billed at $1.99 monthly or $20.99 annually. Payment is processed at the start of each billing cycle.
• Monthly Diamond Bonus: Pro members receive 200 Diamonds monthly as part of their subscription benefits.
• Cancellation: You may cancel your Pro Membership at any time through your account settings or payment provider. Upon cancellation, your Pro benefits will remain active until the end of your current billing period. No partial refunds are provided for unused time.
• After Cancellation: Once your Pro Membership expires, you will revert to a free account. Any exclusive Pro features or cosmetics will become inactive until you resubscribe.
• Price Changes: We reserve the right to change subscription pricing. Existing subscribers will be notified in advance of any price changes affecting their renewal.

7. Tests & Examinations

Our platform includes features for creating, hosting, and participating in MCQ tests and examinations.

• Content Ownership: Test creators retain ownership of the questions and content they create. By sharing tests, you grant us a license to display and distribute them on the platform.
• Academic Integrity: Users are expected to maintain academic integrity when participating in tests. Cheating, sharing answers, or using unauthorized aids is prohibited.
• Host Responsibilities: Test hosts are responsible for the content of their tests and for managing their test sessions. We are not responsible for the accuracy or appropriateness of user-generated test content.
• Test Sessions: Test session invitations can be sent to friends. Invited users can accept or decline these invitations. Host can stop or manage sessions at their discretion.

8. Community & Conduct

Our platform includes social features such as Chats, Groups, and Communities. You agree to use these services respectfully.

• Prohibited Content: Hate speech, harassment, sexually explicit content, spam, and illegal activities are strictly prohibited.
• Moderation: Community admins and platform moderators have the right to remove content and ban users who violate community guidelines.
• Safety: Do not share sensitive personal information (like financial data or home addresses) in public or private chats.
• Reporting: Users can report inappropriate content or behavior. We will review reports and take appropriate action.

9. Notifications & Invitations

By using this platform, you consent to receive notifications related to your account and platform activities.

• Platform Notifications: You may receive notifications for friend requests, group/community invitations, test invitations, quest updates, and achievements.
• Friend Requests: You can control whether you receive friend requests through the "Allow friend requests" toggle in Settings.
• Invitations: You can accept or decline group, community, and test session invitations. Declining an invitation does not affect your ability to be invited again in the future.

10. Content & Intellectual Property

All platform content, including but not limited to designs, text, graphics, logos, and code, is the property of Cibru. Users retain rights to the content they post but grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content on the platform.

11. Account Termination & Data Deletion

We reserve the right to suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or harm other users.

• Self-Deletion: You may delete your account at any time via the Settings menu.
• Data Removal: When you delete your account, your profile information, personal data, and private messages will be permanently removed. However, messages you sent in groups and communities may remain visible to other members (displayed as "Deleted User").
• Content Retention: For legal, security, or technical reasons, some data may be retained in our backups for a limited period after deletion.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

• Cibru shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.
• We are not responsible for any loss of data, including but not limited to test content, messages, or user-generated content.
• We are not liable for any content posted by users, including defamatory, offensive, or illegal content.
• Service interruptions, downtime, or technical failures do not entitle users to compensation.
• Our total liability to you for any claims arising from your use of the service shall not exceed the amount you paid to us in the 12 months preceding the claim.

13. Disclaimer of Warranties

The service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. We do not guarantee that the service will be uninterrupted, secure, or error-free. We make no warranties regarding the accuracy, reliability, or completeness of any content on the platform.

14. Changes to Terms

We may modify these terms at any time. Continued use of the platform after changes constitutes acceptance of the new terms. Significant changes will be notified via platform announcements or notifications. We encourage you to review these Terms periodically.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts in India.
